When you engage an expert, you don't just want an opinion, which you could get from a relative or friend who knows the building trade.
When you consult an expert, in addition to his opinion you expect to get statements, observations, recommendations, assessments and other viewpoints included in his report. You expect the expert to accept professional liability for the content of the report, and therefore to offer you a real guarantee.
If there is a dispute concerning the building, the forensic expert accepts liability in two ways:
-
Firstly towards the owner (claimant or principal) by guaranteeing his assessment of the elements of the structure that he declares compliant
-
Secondly, towards the opposing party (companies, property developer or builder) likely to challenge the viewpoints presented in his report, regarding the poor quality of their work or their liability for a certain type of damage.
In the event of appraisal of the value, the expert is liable in the same way towards the claimant. If the claimant can prove that the expert has made an error in the appraisal, the claimant can request from the court the repayment of the loss resulting from the error.
The expert does not give a verbal opinion, but he does produce written reports for which he is liable.
The services provided by LAMY SA Expertise therefore offer the advantage of the guarantee of its professional liability.
